Important information

Damage to Vehicle

You may be responsible for any loss or damage to the vehicle, as well as any related costs or fees, during the rental period, even if you are not at fault. If the vehicle is used in line with this Agreement, your maximum liability will be limited to the Loss Damage Liability (LDL) amount for each incident. The LDL amount will be stated in your Rental Agreement.

We offer Ride Waivers that you can purchase to reduce the amount of your LDL. These waivers include cover for ancillary damage items such as tyres, windscreen, vehicle keys, vehicle accessories and towing fees. Your liability will be limited to the cost of the damage (plus any applicable administration fees), capped at the LDL amount applicable to the Ride Waiver you select.

Neither the Loss Damage Liability (LDL) nor the Ride Waivers will reduce your liability if the loss or damage results from a Prohibited Use of the vehicle. In such cases, you will remain fully liable for the loss or damage, up to the full value of the vehicle, as well as any related losses, fees, and third-party claims.

1.1 Prohibited Use

Prohibited Uses that may result in full liability include, but are not limited to, any of the following actions by you or an authorised driver: incurring damage to the overhead or undercarriage of the vehicle, driving on unsealed roads, failing to take reasonable precautions to safeguard the vehicle (such as leaving keys in the vehicle), or permitting an unauthorised driver to operate the vehicle.

1.2 Ride Waivers

You may reduce your liability for damages and other associated fees by selecting a Ride Waiver, which limits the applicable Loss Damage Liability (LDL) amount depending on the waiver selected.

A Ride Waiver will cap your maximum liability for loss or damage to the vehicle (including damage to tyres, windscreens, vehicle keys, vehicle accessories, and towing fees). If the actual cost of damage is less than the applicable LDL, you will only be liable for the actual repair or replacement cost, plus any applicable administrative fees.

Notwithstanding your selection of a Ride Waiver, your liability will not be reduced or eliminated if the loss or damage results from a Prohibited Use of the vehicle. For further details, please refer to the section on Optional Renter Protection Services.

1.3 Personal possessions in the vehicle

Ride Car Rentals shall not be liable for any loss or damage to your personal belongings or those of your passengers within the vehicle, including but not limited to incidents involving accidents, break-ins, or theft of the vehicle.

1.4 Accessories

You are responsible for any loss or damage to accessories up to your Loss Damage Liability (LDL) per item, except in the case of infant seats and GPS units, where you will be liable for the total loss of the item.

1.5 Purchase of Insurance from Third Party

If you obtain excess waiver insurance or a similar product from a third party (and not directly through Ride Car Rentals) to cover your liability to Ride Car Rentals, you will remain liable to us for payment up to the full extent of the Loss Damage Liability (LDL).

1.6 Pick Up

Prior to departing, you are required to inspect the vehicle for any existing damage and document any damage on the Vehicle Condition Report, either in collaboration with a Ride Car Rentals staff member or through the electronic platform we provide. You are encouraged to take a time-stamped photograph of any pre-existing damage and email it to support@riderental.com.au prior to leaving the rental location. Additionally, you must present the photograph to a Ride Car Rentals representative upon returning the vehicle.

1.7 Roadside Assistance

We provide basic roadside assistance with the vehicle; however, this service does not cover incidents that result from your actions or negligence, including but not limited to running out of fuel or battery, losing keys, or locking keys inside the vehicle.

The Roadside Assistance number should be contacted in the event of an accident or breakdown. In the event that a tow is required due to the electric vehicle’s battery being fully discharged, you will be liable for the costs.

1.8 Return

Additional charges may apply if the vehicle is returned at a time different from the agreed-upon return time or if it is returned in an excessively dirty or odorous condition. Smoking within the vehicle is strictly prohibited. Should the vehicle be returned with an odour of smoke, an additional cleaning fee will be imposed. For further details, please refer to Annexure 3 – Damage Policy.

1.9 Out of Hours Return

If we agree to allow you to return the vehicle outside of regular location hours, please note that you will remain responsible for the vehicle until our staff takes possession of it when the location reopens. For further details, please refer to the “Return” section.

1.10 Vehicle Definitions

  1. ‘ICE Vehicle’ means a road vehicle with an internal combustion engine, powered by petrol or diesel fuel.
  2. ‘EV’ means a road vehicle with an electric motor, powered by electricity stored in a battery.
  3. ‘Commercial Vehicle’ means a motor vehicle capable of carrying goods, 10 or more passengers and can be used for industrial and agricultural purposes.
  4. ‘Heavy Commercial Vehicle’ means a vehicle classed as a heavy truck or bus that requires a ‘specialized vehicle’ license to drive. It is a vehicle that has a gross vehicle mass (GVM) or aggregate trailer mass (ATM) of more than 4.5 tonnes.
  5. ‘Vehicle’ means the road vehicle you have rented, which may be any of the above, and includes all vehicle parts, tyres, tools (supplied with the vehicle), and all other accessories or equipment in or fitted to the vehicle by the manufacturer or by Ride Car Rentals, such as keys, child restraint seats, GPS devices and Vehicle Monitoring Systems.

2. What is included in the rental rate

2.1 Kilometres

Your Rental Agreement may specify that a per-kilometre charge will apply if the daily kilometre limit is exceeded, depending on the type of vehicle rented. If a distance limit applies, the daily kilometre allowance will be clearly indicated in your Rental Agreement. Should you exceed this daily allowance, an additional charge may be applied for the extra distance covered.

2.2 Initial Tank of Fuel

Your vehicle will be provided with a full tank of fuel. If the tank is not full upon pick-up, we will provide credit for the missing fuel. You will then have the option to choose how to pay for the fuel used during your rental.

2.3 Electricity

Ride Car Rentals will provide the electric vehicle (EV) with up to 90% charge at the time of rental.

You may either return the EV with the battery at the same charge level as at departure, or you may opt to pay for recharging the EV upon its return. For further details on charges related to fuel and electricity recharging, please refer to Annexure 1 (Charges Explained).

2.4 Roadside Assistance

A basic breakdown service is included in your rental, covering callouts for mechanical faults and accidents where you are not at fault (excluding third-party accidents). However, if you are at fault (for example, if you lock the keys in the vehicle or run out of fuel or electricity while on the road), you will be charged a Roadside Assistance fee.

3. What is NOT included in the rental rate

3.1 You have the option to add the following items to your rental for an additional charge

  1. Additional driver – We will need to see their driver’s licence and an additional form of Identification.
  2. Additional options
    1. Booster seat
    2. Child seat
    3. Vehicle drop off
    4. Unlimited Kilometres
  3. Fuel Purchase Option for ICE Vehicles – You may choose to pre-pay for a whole tank of fuel in advance, so you don’t need to fill the tank on return (although no refund will be given for any unused fuel).
  4. Electricity for EVs – Rental rates do not include the cost of electricity required to charge an EV. If the EV is returned with a charge level below the battery departure level, or if the EV is recharged by a third party that invoices Ride Car Rentals instead of you, additional charges will apply (see ‘Electric Vehicles (EVs)’ section below for more information).
  5. Ride Waivers in Annexure 4 are available for purchase at an additional charge. These waivers reduce your liability to Ride Car Rentals for loss or damage to the vehicle, provided the vehicle is not used in a manner prohibited under this Agreement. The applicable Ride Waiver will reduce your maximum liability (excess) and apply to all loss or damage to the vehicle, including damage to tyres, windscreens, keys, accessories, and towing fees. If the actual cost of the damage is less than the reduced excess, you will only be liable for the actual cost of the damage plus any applicable administrative fees. Details of the applicable waiver and the reduced liability will be set out in your Rental Agreement.Please note: Heavy Commercial Vehicles, this product will reduce liability to the sum shown in the rental agreement (it will not reduce liability to zero)
  6. Toll Cover – You can pre-pay your toll charges incurred during your rental for a daily flat fee as advised at the time of reservation.

3.2 A range of fees and charges may apply to your rental (see Annexure 1 (Charges Explained)). The amounts may be specified in the Rental Agreement provided to you on pick up. We do not cover you for:

  1. Parking and traffic fines you incur;
  2. Private parking charges; and
  3. Road tolls (unless you have purchased Toll Cover).

If we receive notices for fines and parking charges during the rental period we will give the authorities your name, address and driver’s licence details and charge an Infringement Administration Processing Fee. Toll charges and Toll Administration Processing Fees will be charged to you directly by Ride Car Rentals (unless You have purchased Toll Cover). These charges will be applied to your chosen method of payment.

4. Basics

4.1 Agreement

  1. Your Rental Agreement with us (Agreement) is comprised of:
    1. the Rental Agreement;
    2. these Ride Car Rentals Terms and Conditions of rental; and
    3. any Additional Terms that may be agreed in writing between You and Us.
  2. When we refer to the ‘Rental Agreement’, it encompasses all of the above documents. In the case of any inconsistency between the Rental Agreement and the Terms and Conditions, the Rental Agreement will take precedence.
  3. The Agreement is made with Ride Car Rentals and is binding and enforceable against the Renter (the person renting the vehicle).
  4. This Agreement shall be governed by, and construed in accordance with, the laws of the State of Western Australia. The parties irrevocably submit to the exclusive jurisdiction of the courts of Western Australia in respect of any dispute or matter arising out of or in connection with this Agreement.
  5. If any term of this Agreement is found to be illegal or unenforceable, that term shall be severed from the Agreement, and the remaining terms shall continue in full force and effect.

4.2 Electronic Signatures

  1. We use electronic signatures as a method of entering into the Rental Agreement. By providing your electronic signature, you are:
    1. Consenting to the use of this method for acknowledging and accepting these Terms and Conditions.
    2. Agreeing to the obligations outlined in the Rental Agreement.
  2. By signing electronically, you confirm your understanding and acceptance of the terms associated with the Rental Agreement.

4.3 Your Booking

  1. When you make a rental booking with us, we will make reasonable efforts to provide the vehicle class you’ve requested, along with any additional equipment (such as GPS or infant seats), subject to availability.
  2. However, even with a valid booking, we may refuse to provide you with a rental car if any of the following conditions are not met:
    1. You do not present an acceptable driver’s license;
    2. You fail to provide the required deposit or charge card;
    3. You fail to pay the rental charges;
    4. You are intoxicated, aggressive, or confrontational with our staff; and/or
    5. Your prior conduct is deemed unacceptable by us.

4.4 Cancellation Policy

  1. You may cancel your booking at any time before the scheduled start time of your rental.
  2. For cancellations, we recommend using the same communication channel you used when booking the vehicle. Alternatively, you can contact our Call Centre at +61 448 142 509 to cancel your reservation.
  3. If you cancel your reservation, a Cancellation Fee will apply.
  4. If you fail to cancel your reservation and do not pick up the vehicle, a ‘No Show’ charge will apply.
  5. If you have prepaid your rental, we will refund the prepaid amount minus the Cancellation Fee or ‘No Show’ charge.
  1. The Cancellation Fee and ‘No Show’ charge reflect the fact that we held the vehicle for you without any rental transaction taking place.

4.5 Responsibility

  1. Ours:
    1. We are responsible to you for providing the vehicle in a safe and roadworthy condition and for replacing the vehicle in the event of breakdown, theft or accident (unless there is a Prohibited Use of the vehicle).
    2. We are not responsible for statements made by travel agents or third-party booking services as they are not our employees or agents.
    3. You have consumer rights conferred by the Australian Consumer Law and the Australian Securities and Investments Commission Act 2001.
    4. Nothing in this Agreement is intended to exclude, restrict, or modify any implied terms, guarantees, or rights you may have under applicable laws, including any Federal, State, or Territory legislation (such as Consumer Protection Law).
    5. To the extent permitted by Consumer Protection Law, our total liability to you under this Agreement whether arising in contract, negligence, equity, statute, or otherwise, and howsoever caused, is strictly limited to an amount not exceeding an amount equal to the hire fees payable for the unexpired portion of the Rental Period as at the date on which the event giving rise to liability occurs. This limitation applies notwithstanding the nature of the claim and includes, without limitation:
      1. loss or damage suffered as a result of an incident that is not covered by any applicable insurance or waiver;
      2. any unauthorised access to, disclosure of, loss, corruption, or misuse of your personal or sensitive information, including as a result of a data breach, except to the extent caused by our gross negligence or willful misconduct;
      3. any indirect, incidental, special, punitive or consequential loss or damage, including but not limited to loss of opportunity, loss of business, loss of income, or loss of enjoyment;
      4. any delay, failure, defect, fault, or breakdown relating to the vehicle, its condition, or our services, including any failure to provide roadside assistance or replacement vehicles.
  2. Yours:
    1. You must care for, use, and return the vehicle in accordance with the terms of the Rental Agreement and ensure that all amounts due are paid. Furthermore, you confirm and agree that all information provided by you, including your contact details, is true and accurate.
    2. You must ensure that you (and any authorised driver) hold a valid licence to operate the type of vehicle rented.
    3. You must ensure that you comply with all applicable laws and regulations relating to the use of the vehicle.

4.6 Privacy

  1. By renting with us, you consent to the collection, use, and disclosure of your personal information, including through in-vehicle tracking via a Vehicle Monitoring System, in accordance with our Privacy Policy. The Privacy Policy is available on our website and is also noted in Annexure 5 (Privacy & Credit Notice).
  2. If we provide you with credit, our Credit Policy, along with our Statement of Notifiable Matters, as detailed in Annexure 5 (Privacy & Credit Notice), will govern the collection, use, and disclosure of your credit information and credit eligibility information (collectively, “credit-related information”).
  3. For further details regarding the collection of your personal information and credit-related information, including the purposes for which your information is collected, please refer to Annexure 5 (Privacy & Credit Notice)

5. Termination of Rental Agreement

5.1 Termination of this Agreement by You

  1. Early Return
    1. You may end this Agreement earlier than the Return Date, by returning the vehicle to the rental location. You must, unless otherwise agreed with the rental location, return the vehicle during business hours.
    2. Please contact the rental location directly to make the necessary arrangements. For further information, including specific rules regarding the return of vehicles outside of operating hours, please refer to the “Return Procedure.”
  2. Breach by Us
    1. You may terminate this Agreement if you are entitled to do so under any applicable Consumer Protection Law.

5.2 Termination of this Agreement by Us

  1. Termination for Special CircumstancesWe reserve the right to terminate this Agreement at any time by providing two days’ written notice (including by email or SMS), or if notice is not reasonably practicable, with no notice, in the event that any of the following Special Circumstances occur:
    1. We are required by the police or any other regulatory authority to regain or take possession of the vehicle;
    2. You have failed to pay an invoice or any other payment request, or your chosen method of payment is declined, or your bank reverses the charges, and you fail to pay the outstanding amount within 24 hours of being notified by Ride Car Rentals;
    3. The vehicle is not returned by the agreed return date;
    4. We reasonably believe that a Material Breach has occurred; or
    5. We reasonably believe that a Material Breach is imminent.
  2. A Material Breach occurs if:
    1. The vehicle is used for a Prohibited Use;
    2. The vehicle is driven on a Prohibited Road;
    3. The vehicle is driven by an individual who does not meet the licence and age requirements set forth in this Agreement;
    4. You or an authorised driver provide false or misleading information to us, either prior to or during the term of the rental, which may reasonably be considered material to our decision to grant and continue granting you the rental. Such material information includes, but is not limited to, matters such as name, licence status, address, or incidents occurring during the rental.
  3. When terminated, you may be liable for the following:
    1. Loss or damage, including Loss of Use, payable until the vehicle has been repaired, replaced, or recovered if it has been stolen;
    2. Loss or replacement of the vehicle due to theft;
    3. Third-party loss;
    4. Storage, towing, repossession, and recovery fees;
    5. Administrative and legal costs associated with recovery; and
    6. Any accrued amounts owed to us prior to termination.
  4. You hereby grant us permission to enter your premises for the purpose of recovering the vehicle. In exercising this right, we will use due care and diligence to avoid causing damage to the premises, except to the extent necessary and reasonable in the circumstances.
  5. You may be placed on Suspended Rental Status, which will prevent you from renting any vehicle from us in the future.
    For further details, refer to the list of Prohibited Uses in Annexure 7.

5.3 Consequences of Termination of this Agreement

  1. Subject to any applicable Consumer Protection Law, upon termination of this Agreement (by either you or us):
    1. Where it is safe and reasonable to do so, you must return the vehicle to the agreed location as reflected in the Rental Agreement and comply with the Returns Procedure upon arrival.
  2. Any obligations under this Agreement that are capable of surviving termination or expiration shall remain in effect.
  3. You must pay any outstanding amounts owed to us under this Agreement.
  4. Subject to any applicable Consumer Protection Law, if you terminate this Agreement due to a breach by us, our liability shall be limited to the amount of money you have paid to us in respect of the rental.

Please note: the charges, fees, and other liabilities that you may be required to pay depend on the specific circumstances of termination. For further details, refer to our Damages Policy in Annexure 3.

6. Electric Vehicles (EVs)

6.1 General

  1. Daily rental rates do not include the cost of electricity required to charge an EV. Ride Car Rentals will provide the EV to you with up to 90% charge and requests that you return it with no less than 15% charge remaining.
  2. You will have access to public charging networks for recharging the EV.
  3. Our EVs are equipped with a standard battery capacity and range. The performance of the battery is dependent on operating conditions, which is the responsibility of the driver.
  4. The battery charging limit on your EV rental should be set to a maximum of 90%. This limit should only be increased to 100% under critical circumstances, as exceeding this limit may lead to significant battery degradation.
  5. Our EVs are provided with two charging cables. It is important to care for both cables and ensure they are returned undamaged with the vehicle. You will be liable for any damage to the charging cables provided with the vehicle. If either cable is damaged, you will be charged the current replacement cost as published on our website at the time of the damage. Please refer to our website for the most current information regarding replacement costs.
  6. Our EVs are also provided with a keycard. You must take good care of this keycard and ensure it is returned undamaged with the vehicle. You will be liable for the cost of replacing a lost or damaged keycard, which will be the current prevailing cost as disclosed on our website at the time of the replacement.
  7. Any damage to the underbody or battery caused by driving over foreign objects is not covered by damage liability reduction or waiver products, and you will be liable for such damage.
  8. Ride Car Rentals will not be responsible for removing any personalization created in the EV, such as signing into services like Netflix or Spotify. You are responsible for logging out of any personal accounts at the end of your rental.

Important

EVs must not be driven through an automatic car wash, as this constitutes a Prohibited Use. Any damage resulting from driving an EV through a car wash is not covered by any damage liability reduction or waiver products, and you will be fully liable for all costs associated with damage arising from this prohibited use.

6.2 EV Additional Charges

  1. Government/Council Road User Recovery:
    1. Government or council authorities (as applicable) may impose road user charges on EVs based on the kilometers driven. Ride Car Rentals will charge any such applicable fees to you. These fees will be collected by Ride Car Rentals and subsequently remitted to the relevant government or council authorities.
  2. Recharging Costs:
    1. If you return the EV with a lower charge than the battery departure level:
      1. You will be charged an EV Battery Recharging Service Fee to bring the battery back up to the original departure level.
      2. If the battery charge level is 15% or lower upon return, an additional Low Battery Recharging Service Fee will apply.
    2. If you return the EV with at least the same charge level as the battery departure level:
      1. If you used a Ride Car Rentals account third-party recharging station, and the recharging cost is billed to Ride Car Rentals (rather than directly paid by you), we will pass these recharging costs onto you, upon receipt of the invoice from the EV charge provider, and apply an EV Administration Processing Fee.
      2. If you recharged the EV entirely at your own expense, no such fees (including the EV Battery Recharging Service Fee or EV Administration Processing Fee) will be applicable. Any applicable charges will be processed to your payment card. For further details on these fees, please refer to Annexure 1 (Charges Explained).

7. Charges

7.1 Pick Up

  1. You agree to pay the rental rate for the vehicle, compulsory fees, any applicable fees for optional services, and any other fees that may arise during your rental.

For a detailed explanation of these fees, please refer to Annexure 1 (Charges Explained).

A valid physical credit or debit card, issued in the name of the renter collecting the vehicle, must be presented at the time of pick-up for security purposes. The credit or debit card must correspond to the renter’s identity. Digital cards are not accepted.

  1. Your Rental Agreement provides an estimate of the charges agreed upon at the start of the rental, based on the period specified in the agreement (if the charges have not been prepaid). If your rental period exceeds the estimated duration, the rental location can provide a full estimate upon request. You agree to pay the estimated charges as well as any additional fees that may arise by the end of the rental period.

Important

We typically reserve an amount on your chosen method of payment (or take a deposit) at least equal to the estimated charges plus a security bond (amount is shown on your Rental Agreement). This reserved amount may be released (or deposit refunded) on return of the vehicle following payment of the rental charges. For a further explanation on the Rental Agreement charges, discuss with the location staff at time of pick-up or check online before travelling. See Annexure 6 (Contacts).

8. Vehicle

8.1 Inspection

  1. It is your responsibility to inspect the overall condition of the vehicle at both the commencement and conclusion of the rental period. A summary of any pre-existing damage will be provided to you in the Vehicle Condition Report included in your Rental Agreement..

(2) You are encouraged to take a time-stamped photograph of any pre-existing damage before leaving the rental location. If adverse weather conditions or insufficient lighting prevent you from taking a photograph at the time of departure, you may take a photograph with a time/date stamp within 60 minutes of leaving the rental location.

Important
You are responsible for returning the vehicle in the same condition in which it was provided to you, subject to fair wear and tear. Please refer to the Damage and Loss section to understand your responsibilities regarding damage and loss to the vehicle. Additionally, please consult
Annexure 3 (Damage Policy) for details on how we will process any damage incurred during your rental.

9. Purchase Options for ICE Vehicles

9.1 Full Tank Option

  1. For your convenience, you may choose to prepay for a full tank of fuel at the start of the rental. This option allows you to save time on refuelling upon return; however, please note that no refund will be provided for any unused fuel.
  2. For information regarding electricity recharging options, please refer to the Electric Vehicles (EVs) section.

  3. Commercial, Premium, and Performance Collection vehicles must be refuelled with the type of fuel specified by Ride Car Rentals location staff.
Important
Fuel gauges may still indicate “full” many Kilometres after it was last re-filled. We ask you refill the vehicle within 15 km of the return location. We reserve the right to apply a small charge if it is subsequently found additional fuel is needed although the gauge shows as full – please ask at the counter for details.

9.2 Child Seats:

It is your responsibility to ensure that appropriate child seats have been fitted for children travelling in the vehicle. Ride Car Rentals is not responsible for any fines, injury, death or other losses caused by not having child seats fitted in the vehicle or by children not being restrained in child seats fitted in the vehicle.

Important
You are required to comply with all applicable seat belt and child seat restraint laws.

Fines may be imposed by law enforcement on any occupant who is not wearing a seat belt or who has not properly fitted or adjusted a child seat restraint. It is your responsibility to ensure that any child seat in the vehicle is properly fitted.

Under no circumstances should a child be left unattended in the vehicle.
You are also responsible for the child seat provided in the vehicle.

Important
Vehicle Cleanliness
You may be subject to an additional Cleaning Fee or Cleaning Administration Fee if the vehicle is returned in an excessively dirty condition or with an excessive odour, including, but not limited to:

  • The smell of tobacco resulting from smoking in the vehicle.
  • Dirt or odour caused by the presence of animals in the vehicle, excluding registered service animals.
  • Excessive dirt, sand, animal hair, or mud on the interior or exterior of the vehicle.

If the vehicle is used for a Prohibited Use:

If the vehicle is used for a Prohibited Use:

You are responsible for any damage or losses up to the full value of the vehicle, as well as any related fees, losses, and expenses, including towing and third-party damage, as outlined in the ‘Damage and Loss’ section.

Your liability will not be limited to the Loss Damage Liability (LDL).

You will forfeit the benefit of any Ride Waiver that you have purchased.

We reserve the right to terminate this Agreement and reclaim the vehicle at any time, at your expense.

10. Drivers

10.1 Additional Driver

  1. As the renter, you may allow other persons (“An Additional Driver”) to drive the vehicle, provided that you have verified that the person meets the age and licence requirements specified in this section.
  2. An Additional Driver must be added as an additional driver on the rental agreement and must provide their licence. An Additional Driver Fee is payable.

10.2 25 years of age

You, and any other person driving the vehicle, must be 25 years of age or older (unless pre-approved in writing by Ride Car Rentals), and must present a valid, current driver’s licence that:

  1. Is provided as a physical copy or a digital copy verifiable by the relevant government agencies at the time of pick-up.
  2. Is in English, or if not in English, is accompanied by a certified English translation.
  3. Is valid for driving the vehicle.
  4. Is not a learner’s permit or exceptional licence.
  5. Has been held for at least twelve consecutive months, either as a provisional or full licence.
  6. Provisional licences are accepted as long as the driver adheres to all the above points and complies with local laws, including displaying any required provisional plates.
  7. The driver must satisfy all other conditions listed in the Rental Agreement or any Additional Terms.

11. Foreign Licences

11.1 You are required to provide a valid driver’s licence that permits you to operate the vehicle in Australia. If your licence is issued outside of Australia, you are required to present either:

  1. A valid International Driving Permit (IDP) that is recognised for driving in Australia; or
  2. A copy of your international licence in English or a translation accompanying your international licence.

12. First Time Renters

12.1 If you are a first-time renter paying with a debit or credit card, and your booking is not associated with a corporate account or insurance replacement rental, additional identification and payment requirements will apply to your rental.

12.2 In such cases, you will be required to provide the following:

  1. Debit or credit card in the name of the renter.
  2. Current proof of address.

13. Bond

13.1 Renters will be required to pay a bond.

  1. The bond amount will be specified in the Rental Agreement and may vary based on factors including, but not limited to, the class of vehicle, rental duration, driver history, and risk profile.

14. During Your Rental

  1. You are responsible for all fines, private parking charges, road tolls, and other similar charges (including parking fines or charges) incurred during the rental period.
  2. We will work with authorities to pass on notices of fines and parking charges to you.
  3. Additionally, we will charge you either the Toll Administration Processing Fee or Infringement Administration Processing Fee (each referred to as a “Processing Fee“).
  1. If you incur toll charges during the rental, we will charge you for the tolls plus the applicable Processing Fee (unless you have purchased Toll Cover). These charges will be processed on the payment method provided in your Rental Agreement, as detailed in Annexure 1 (Charges Explained).

15. Toll Cover

15.1 You have the option of purchasing Toll Cover to pre-pay a flat daily rate for toll charges incurred during your rental.

For details, please refer to Annexure 4 (Ride Waivers).

16. Offences During Rental

16.1 If an offence occurs during the rental period:

  1. You will be liable for the costs associated with that offence, whether or not you were the driver at the time.
  2. We will transfer liability for the offence to you by passing on your details to the relevant authority and charge you a Processing Fee. The Processing Fee will be charged to the card provided at the time of rental.
  3. You have the right to challenge, complain about, query, or object to the alleged offence directly with the issuing authority.
  4. You also have the right to request a court hearing in connection with any offence (but this must be done within 56 days of the offence notice being issued, or within 28 days of the reminder notice).
  5. Unsuccessful Transfer of Liability: If we are unable to transfer liability for the offence to you by passing on your details to the relevant authority, we will charge your card for the total amount of the offence, and we will pay this amount to the appropriate authority as soon as possible.

Important:

In addition to any fines, parking charges, or tolls you incur, we may also apply a Processing Fee to cover the time and costs associated with dealing with these matters. For more details, please refer to Annexure 1 (Charges Explained).

17. Breakdown Assistance

17.1 General

If you experience any issues with the vehicle due to mechanical failure, you agree to stop driving (as soon as practicable), park the vehicle, and contact our roadside assistance (see Annexure 6 for contact details). They will arrange help for you. You must not resume driving the vehicle unless directed by roadside assistance. You must not move the vehicle unless it is necessary to prevent further damage to the vehicle or to other property or vehicles.

17.2 Premium and Performance Collection Vehicles

  1. If the vehicle is from our Premium and Performance Collection, you may receive roadside assistance directly from the manufacturer. Details of this service can be found in the vehicle’s service book. You must contact the manufacturer’s roadside assistance service if:
    1. A warning light or message becomes illuminated or displayed on the vehicle; and/or
    2. Any other event affects the performance or safety of the vehicle.
  2. If you are unable to contact the manufacturer’s roadside assistance service, please contact Ride Car Rentals’ roadside assistance or our customer care centre (see Annexure 6 for contact details).

17.3 Cost

  1. We will provide roadside assistance free of charge for issues not caused by you. However, if the issue was caused by your actions (e.g., running out of fuel, losing the keys, or locking the keys in the vehicle), you will be responsible for the costs of roadside assistance and any parts provided.
  2. For specific charges related to roadside assistance and towing, please refer to Annexure 1 (Charges Explained).

17.4 Repairs

  1. You must not allow anyone to service or repair the vehicle without obtaining our prior written consent.

17.5 Care

  1. You are responsible for the general care of the vehicle and for minimising the risk of breakdowns and damage. This includes ensuring the vehicle is not used in a prohibited manner (as defined below) and that the correct fuel is used. You must also regularly check that the tyre pressures, oil, and other fluids are maintained at the specified levels, refilling as necessary.
  2. Please refer to Annexure 1 (Charges Explained) and Annexure 4 (Ride Waivers) for more details.

18. Accident or Theft

18.1 General

  1. If you are involved in an accident or if the vehicle is stolen, you agree to cooperate fully with us and/or our insurer in any investigation or subsequent legal proceedings.
  2. Failure to cooperate may result in additional costs or damages being charged to you.
  3. In such an event, you must take the following steps:
    1. Notification:
      1. You must inform Ride Car Rentals immediately if the vehicle is involved in an accident or stolen, regardless of whether there is any visible damage. You are required to report the incident to Ride Car Rentals as soon as practicable and within 24 hours. If you fail to notify us within this timeframe, and this delay leads to additional costs for Ride Car Rentals, you may be charged for those costs.
      2. If anyone is injured or if property is damaged, you must report the incident to the police as soon as possible.
    2. Vehicle Incident Report (VIR):
      1. You must complete the VIR, providing all relevant details of the accident or theft, including third-party information, even if no damage occurred to the vehicle. The VIR must be signed by you and submitted to a member of staff

when you return the vehicle. Alternatively, you can find the VIR online or refer to Annexure 3 (Damage Policy).

  1. If the accident involves another vehicle, you must gather the following details from the other driver:
    1. Name, address, and phone number,
    2. Insurance company information,
    3. Driver’s license number,
    4. Vehicle registration number, make, and model,
    5. A copy of the police report, if applicable.

18.2 Under no circumstances should you admit fault at the scene.

18.3 Replacement Vehicle at Ride Car Rentals’ Discretion

  1. Ride Car Rentals may, at its discretion, choose to terminate your rental and not provide a replacement vehicle if the car is involved in an accident or stolen.
  2. Additional details regarding accidents are outlined in Annexure 3 (Damage Policy).

Important

Information Provision:
You must provide all information related to the accident within 48 hours of any requests made by Ride Car Rentals or our insurer. This includes any papers or documents you receive regarding the accident.

Termination of Rental:
Ride Car Rentals may, at its discretion, terminate your rental of the vehicle and any accessories and may choose not to provide a replacement vehicle if the accident or theft resulted from a Prohibited Use of the vehicle.

Consent to Obtain Police Reports:
You consent to and authorize Ride Car Rentals and/or our insurer to obtain copies of any police witness statements, reports, or details regarding charges made in relation to the accident or theft.

19. Damage and Loss

19.1 Responsibility

You are responsible for the vehicle if it is lost, stolen, abandoned, or damaged during the rental (e.g., involved in an accident), even if it was not your fault (e.g., another driver’s fault). This liability applies except where:

  1. The damage constitutes fair wear and tear, as defined in Annexure 3 – Damage Policy.
  2. The loss or damage is directly due to our negligence or willful default, such as our failure to maintain the vehicle properly.
  3. The damage or loss was caused by a third party, and you have met your obligations under the Accidents section by providing us with sufficient details about the third party and/or their insurer, allowing us to recover the loss or damage from them.
  4. In such cases, we may charge you the estimated damages or your applicable liability (whichever is lower) per incident. Once we recover the loss or damage, we will refund any difference owed to you.

Note: Damages include personal injuries covered by compulsory third-party insurance or statutory transport accident compensation schemes.

19.2 Important: Incident Damages

If the vehicle (including keys or accessories) is lost, stolen, or damaged, for each incident you are responsible for:

  1. The loss or damage to the vehicle.
  2. Any towing and storage charges.
  3. Loss of rental income.

20. Other related losses or expenses

  1. This is subject to the Loss Damage Liability (LDL) amount per incident.
  2. To benefit from any reduced or waived liability, you must complete a Vehicle Incident Report (during or within 24 hours of the end of your rental period).
  3. The report can be obtained at the rental counter or accessed online (refer to Annexure 3 – Damage Policy).

21. Calculation of Loss of Rental Income

  1. Loss of rental income will be calculated by multiplying the number of days the vehicle is unavailable for rent (due to repairs or replacement) by 70% of the current daily rental rate for that vehicle.

22. Ride Waivers

  1. If you have purchased a Ride Waiver, your liability for loss or damage to the vehicle (and other incident-related charges) will be reduced to the amount specified in your Rental Agreement, provided the vehicle is not used for a Prohibited Use. The applicable Ride Waiver determines the reduced liability amount (excess) and covers all damage to the vehicle, including tyres, windscreens, keys, accessories, and towing fees. If the actual cost of damage is less than the reduced liability amount, you will only be liable for the actual cost of the damage plus any applicable administrative fees.Note: Ride Waivers do not reduce your liability to zero for certain vehicles, such as Heavy Commercial Vehicles or high-value vehicles in the Premium and Performance Collection (as specified in your Rental Agreement).

23. Consequences of Using Vehicle for a Prohibited Use

23.1 Liability for Loss or Damage

  1. If the vehicle is used for a Prohibited Use and this either caused or contributed to the loss or damage to the vehicle, you may be liable to us for that loss or damage up to the full value of the vehicle.
  2. You may also be liable for:
    1. The Ride Car Rentals Claims Management Fee and External Damage Assessment Fee if the damage involves the body of the vehicle, or Processing Fees for other types of loss or damage (e.g., cleaning due to smoking in the vehicle).
    2. Any towing and storage charges.
    3. Loss of rental income.
    4. Other losses or expenses related to the incident.

23.2 Liability Beyond LDL:

Your liability to us will not be limited to the Loss Damage Liability (LDL) if the vehicle is used for a Prohibited Use or otherwise in breach of this Agreement. In such cases, Ride Waivers will not apply to reduce or eliminate this liability.

23.3 Third-Party Property Damage:

  1. You are also responsible for any third-party property damage or loss arising from the Prohibited Use of the vehicle. You hereby indemnify us against any claims made against Ride Car Rentals for that damage or loss.
  2. Your liability for personal injuries resulting from the Prohibited Use is covered by statutory transport accident compensation schemes in each State or Territory, subject to the terms and conditions of those schemes.
  3. Ride Car Rentals may charge you for any third-party property damage or loss arising from those a Prohibited Use via your chosen payment method provided at the time of rental.

For details on the Ride Car Rentals Claims Management Fee, External Damage Assessment Fee, or Processing Fees, please refer to Annexure 1 (Charges Explained) and consult the information available online.

Important

If the vehicle is lost or damaged due to a Prohibited Use, you are responsible for:
• The cost of repairs or the full value of the vehicle.
• The Ride Car Rentals Claims Management Fee, External Damage Assessment Fee, or any Administration Fee.
• Any towing or storage charges.
• Loss of rental income (see “Calculation of Loss of Rental Income”).
• Other losses or expenses related to the incident, including third-party costs and losses.

If the vehicle is used for a Prohibited Use, to the extent allowed by applicable law, your liability will not be limited, and any Ride Waivers you have purchased will be void.

24. Calculating and Charging for Damage

The following process for calculating and charging for damage applies only if you did not select a Ride Waiver.

If you select a Ride Waiver, you will be liable for the actual cost of damage plus any applicable administrative fees, up to the maximum liability cap stated in your Rental Agreement.

24.1 Vehicles that are Lost, Stolen, or Involved in an Incident with a Third Party:

If the vehicle is lost, stolen or damaged, or if a third party is involved in the incident, Ride Car Rentals will charge your card (as defined in Annexure 1 (Charges Explained)) at the Loss Damage Liability (LDL) level indicated on your rental agreement while we investigate the incident and assess the damage.

24.2 After the investigation and damage assessment:

If Ride Car Rentals finds that you were not liable and is able to recover the full amount from the third party, the amount charged to your card will be refunded.

24.3 If Ride Car Rentals finds that you are liable:

  1. If the LDL amount charged on your card was more than the amount of Incident Damages, Ride Car Rentals will refund the difference.
  2. If the amount of the Incident Damages exceeds the LDL amount charged on your card, no further charges will be levied.

24.4 Vehicles Damaged Without Third-Party Involvement:

  1. If the vehicle is damaged and no third party is involved, Ride Car Rentals will notify you (via email, if provided) that a damage incident has been recorded and that a damage assessment will commence.
  2. After the assessment, if it is determined that you are responsible for the damage, Ride Car Rentals will charge your card (as defined in Annexure 1 (Charges Explained)), with prior notification (if you have provided a valid email address). The amount charged will be based on the Incident Damages assessed, up to the LDL amount stated on your rental agreement.

If you have selected a Ride Waiver, the amount charged will be limited to the actual cost of the damage plus any applicable administrative fees, capped at the reduced liability amount stated in your Rental Agreement.

24.5 Prohibited Use

If Prohibited Use led to the loss or damage, you will be responsible for all costs and damages associated with the incident, even if you have purchased PP or UP.

25. Security

  1. You are responsible for ensuring the security of the vehicle and any accessories provided during your rental period.
  2. To minimise the risk of theft or vandalism, always park the vehicle in a safe place, remove any valuable items from sight, and ensure the vehicle is properly locked.

26. Purchase of Insurance from Third Party

If you have purchased excess waiver insurance or a similar policy from a third party to cover your liability to Ride Car Rentals, you will remain liable for payment to us, regardless of whether you obtain reimbursement from your insurer.

27. Personal Possessions

  1. You are responsible for the loss or damage to your personal possessions, or those of your passengers, in the vehicle, even if it was not your fault.
  2. Your liability for loss or damage to personal possessions will not be limited to the Loss Damage Liability (LDL).
  3. Personal possessions are not covered by any Ride Waivers.

28. Return

28.1 Obligation to Ensure Vehicle is Returned

  1. You must ensure the vehicle is returned:
    1. To the return address and by the time reflected on your Rental Agreement.
    2. In the same condition as it was at the start of your rental period, subject to Fair Wear and Tear.
  2. If the vehicle is not returned as per the agreement, except in cases of theft or accident, you will be in Material Breach of this agreement.

28.2 Variations (Requesting Changes to Return Details):

If you need to change the return time, date, location, or arrange for collection of the vehicle:

  1. You must phone the contact number provided in the Rental Agreement and request the change before the scheduled return time.
  2. All changes to the Rental Agreement are subject to our discretion.
  3. Additional charges may apply depending on the nature of the changes. These charges will be explained when you contact the return location.

28.3 Examples of Additional Charges:

  1. One-Way Fee: If the vehicle is returned to a different location than agreed.
  2. Delivery & Collection Fees: If we arrange to collect the vehicle from a different location.
  3. Additional Rental Day: If the vehicle is returned later than agreed, and the return is within staffed hours, you may incur an extra rental day charge.
    1. If the vehicle is returned within 59 minutes of the agreed return time, you will not be charged an Additional Rental Day.
  4. If the return date extends beyond the agreed period, additional fees will apply based on the extended rental period.

28.4 Key Information:

  1. Rental charges are calculated in 24-hour periods from the time noted in your Rental Agreement.
  1. If the vehicle is returned late, a new 24-hour period will begin, and you will be charged accordingly.
  2. Grace period: Typically, we offer a short grace period for returns, meaning you may return the vehicle slightly later without incurring an extra day’s charge.
  3. Returning the vehicle to a different location may incur a One-Way Fee and additional charges.

28.5 Outside of Operations Hours:

If you wish to return the vehicle outside of staffed hours, this must be agreed upon by both parties.

29. General Return Procedure

29.1 Personal Property Removal

  1. Before returning the vehicle, remove all personal possessions. Ride Car Rentals is not responsible for loss or damage to your or your passengers’ personal belongings during or after the rental period.
  2. While we will try to return any items we find, we are not liable and any costs for returning property will be your responsibility.

29.2 Fuel and Electrical Charging

Ensure the vehicle is returned in accordance with the Fuel and Electrical Charging Policy provided in Annexure 2.

29.3 Vehicle Inspection

  1. We will inspect the vehicle for damage or loss as soon as possible, generally within 60 minutes of return (or when the location reopens).
  2. If you return the vehicle outside of staffed hours, the inspection will be completed in your absence.
  3. We will compare the condition of the vehicle against the Vehicle Condition Report from the start of the rental and any time-stamped photos of the vehicle’s condition.
  4. Any damage identified during the inspection will be subject to the Damage Policy outlined in Annexure 3.

29.4 Special Return Procedure – Outside Operating Hours

If you return the vehicle outside of normal operating hours, you must:

  1. Confirm the location where the vehicle should be parked and where the keys should be placed after locking.
  2. Do not give the keys to anyone, even if they seem to be Ride Car Rentals staff.
  3. Take time-stamped photos of the vehicle’s condition and email them to support@riderental.com.au.
  4. After-hours fees may apply (refer to Annexure 1).

29.5 Missing Key Not Returned

  1. If you forget to return the key, we will attempt to contact you.
  2. You must return the key to the Ride Car Rentals location or the location where the vehicle was returned within 24 hours.
  3. If the key is not returned in that time, it will be treated as Prohibited Use, and you will be charged for the key replacement cost.

29.6 Providing Credit

  1. If you do not pay the full balance due when returning the vehicle (e.g., due to an issue with your credit card), we will treat this as an application for credit. The balance will be deferred for at least 7 days.
  2. We will notify you of the amount and payment due date.
  1. On the due date, we may process the payment on your card.

30. Charges on Return

30.1 Additional Charges

  1. We will inspect the vehicle and notify you of any additional charges, such as for fuel or damage.
  2. A revised invoice will be provided if the amount due differs from the original estimate, and this will be charged to your card upon return.

30.2 Unfinalised Charges

Some charges, like fines, tolls, or damage costs, may not be finalized immediately. We may charge your card for these within 90 days of the rental period.

30.3 Outstanding Charges

If charges are not paid within 7 days, you agree this will be treated as an application for credit.

30.4 Interest on Overdue Payments

If you fail to pay the amounts due, we will charge interest calculated from the due date until the payment date. The rate of interest is outlined in Annexure 1.

31. Charging Your Card

31.1 Payment Method

  1. You must pay with an accepted credit card or Visa/MasterCard debit card.
  2. We may reserve credit or obtain authorization for the estimated rental cost and security bond at the time of reservation.

31.2 Authorisation Release

After the vehicle is returned, any authorization will be released, and you can pay any remaining balance with card.

31.3 Authorisation to Charge

You authorise Ride Car Rentals to charge the card provided for any amounts owed under this agreement, up to 90 days after vehicle return.

32. Credit Under the Agreement:

If credit is provided (e.g., payment deferred), we may be classified as a credit provider under the Australian Privacy Act 1988 and the Credit Reporting Code.

ANNEXURE 1 – CHARGES EXPLAINED

Charges

  1. Your Rental Agreement will provide an estimate of the charges that apply to your rental for the maximum number of days specified. These charges may typically include:
Compulsory
Rental Rate

The daily rental charge noted on the Rental Agreement for each rental day unless otherwise stated in the Rental Agreement or in Additional Terms.

The extra hours rate shown on the Rental Agreement is charged for each full or partial hour in excess of a full Rental Day until the amount reaches the cap on the daily rental charge.

Kilometre Rate

You may have limited kilometres depending on your pickup location.

If a limit on distance applies, the daily kilometre allowance will be shown on your Rental Agreement and may vary based on the type of vehicle. If you exceed this daily allowance, a charge may apply for the distance covered.

Young Driver Surcharge

Will apply if you or any additional driver is 24 years and under.

You will be advised of the surcharge at the time of reservation.

Administration Fee A percentage rate as noted on the Rental Agreement in relation to administration functions undertaken.
Optional
Additional Driver We apply a standard fee for each additional driver added to your rental. You will be advised of the surcharge at the time of reservation.
One Way Fee May apply if you return the vehicle to a location different from the start location. You will be advised at the time of reservation if you are permitted to return the vehicle to a different location and if so, any applicable fee.
After Hours Fee May apply if you request that your vehicle be available for collection outside a Ride Car Rentals location opening hours. You will be advised of the charge at the time of request.
Delivery & Collection Fees May apply if you request that your vehicle is delivered to or collected from a location other than our rental location. You will be advised of the charge at the time of the request.
Ride Waivers

For the purposes of these Terms and Conditions, Ride Waivers refer to optional add-ons that you may elect to purchase or accept, which provide for a reduction or elimination of your financial liability for loss or damage to the rental vehicle, subject to the terms and conditions set out herein. The availability, scope, and cost of such waivers will vary depending on the vehicle category and other factors determined by the rental provider.

Your Rental Agreement will clearly indicate whether a Ride Waiver has been accepted, declined, or otherwise included in the total rental rate. The selected waiver will specify the extent to which your Loss Damages Liability (LDL) is reduced, including any applicable excess amounts or caps.

If the actual cost of damage is less than the applicable liability cap, you will only be required to pay the actual cost of the damage plus any applicable administrative fees.

Please note that Ride Waivers do not cover liability arising from prohibited uses of the vehicle, nor do they extend to personal possessions, optional accessories, or ancillary charges unless explicitly stated. Where there is a Prohibited Use or other breach of the Rental Agreement, Ride Waivers will not apply, and you will remain fully liable for all loss or damage (up to the full value of the vehicle), third-party claims, and associated costs. Your liability under the Rental Agreement remains subject to all other terms including but not limited to exclusions related to misuses, negligence, or violation of applicable laws.

The precise terms, conditions, and costs of each Ride Waiver option, including any restrictions on eligibility based on vehicle type or rental duration, will be set out in Annexure 4 (Ride Waivers) and incorporated herein by reference.

You acknowledge that acceptance of a Ride Waiver is voluntary and that declining a waiver will result in full application of the LDL as specified in your Rental Agreement.

Early Return Fee May apply if you return the vehicle prior to the return date and time outlined on your agreement.
Optional Equipment The Rental Agreement lists any optional equipment you have selected, such as infant seats, and GPS, showing the full charge for the rental period.
Card surcharge The percentage rate as noted on the Rental Agreement of any amount charged to a Card.
Total
Estimated Rental Charge

Your total estimated charges list the rental rate, discounts and applicable kilometre charges at the start of the rental excluding GST.

Charges are ‘estimated’ because they exclude any potential fuel or other charges you may incur through your use of the vehicle during your rental and only display the maximum number of days as noted on your Rental Agreement.

Subtotal Your subtotal before any applicable fees are applied.
Total Estimated Rental Charges Total of all estimated charges including GST.

Potential Additional Fees

  1. You may incur additional fees due to your use of the vehicle or other incidents during the rental period, aside from your liability for damage or loss to the vehicle. These may include the following:
Fuel / Battery
Refuelling Price

If you don’t fill up the vehicle on return and haven’t opted for FPO, we will charge you a price per litre to fill the tank.

The refuelling price is specified on the Rental Agreement.

Fuel Purchase Option (FPO) You have the option of paying for a full tank upfront at a rate per litre advised to you at the time of reservation (although no refunds are given for any unused fuel).
EV Battery Recharging Service Fee

You are responsible for any reduction in battery charge percentage from the time you pick up the Electric Vehicle (EV) to when you return it. No refund will be provided if the battery charge percentage is higher upon return.

If the EV needs to be recharged to restore it to its departure battery level, we will charge you for the cost of recharging at a rate per kilowatt (kW), as specified in your Rental Agreement.

EV Low Battery Recharging Service Fee If you return the vehicle at 15% battery charge level or less, we will charge an additional recharging service fee, as detailed on your Rental Agreement.
Vehicle Condition
Claims Management Fee Fixed charge to recover our costs for dealing with damage caused to the vehicle.
External Damage Assessment Fee Damage assessment fee charged to Ride Car Rentals by an external damage assessor.
Cleaning Fee A charge imposed in respect of an excessively dirty vehicle which requires cleaning beyond Ride Car Rental’s standard cleaning practice.
Accessories Replacement Fee The replacement cost (at current retail replacement value) of any damaged, lost or missing accessories (including any courier or delivery charges).
Cleaning Administration Fee A fixed charge to recover our costs if cleaning is performed by a third party or specialised cleaner.
Vehicle Use
Infringement Administration Processing Fee The amount payable for administrative functions Ride Car Rentals undertakes including the payment of, or handling of any claim for, any charges and penalties, such as processing of traffic & parking fines, speeding and traffic infringements.
Toll Administration Processing Fee The amount payable for administrative functions Ride Car Rentals undertakes including the payment of, or handling of any claim for charges and penalties related to the use of toll road. Such as toll way use (where Toll Cover is not purchased).
Roadside Assistance If the driver is at fault for the problem for which assistance is requested, for example, the vehicle running out of fuel, or the keys being locked in the vehicle, this fee is the cost of providing breakdown or roadside assistance. If the driver is at fault and the vehicle requires a tow, any towing costs will also be on charged to you.
Towing Included in the LDL unless the driver has engaged in a Prohibited Use or is otherwise at fault.
EV Administration Processing Fee The amount payable for administrative functions Ride Car Rentals undertakes (including making payments, or handling claims, charges or penalties) related to the use of 3rd Party EV recharge stations, as detailed on your Rental Agreement.
Early / Late Return
Additional Rental Days

You may be charged an extra day’s rental at the then current rates for each 24-hour period entered following the return time at the then current rental rates, although you are allowed a ‘grace period’ of:

  • 0 to 59 minutes late: no charge
  • 60 to 119 minutes late: 1/2 of daily rental charge for that vehicle
  • 120 minutes to one day late: daily rental charge for that vehicle

Daily rental charge for that vehicle for each additional day (or any part thereof) vehicle is returned late.

Charges for and Interest on amounts due If you do not pay the amounts due to Ride Car Rentals under the Agreement (including any credit provided to you) in accordance with the Agreement, where interest is payable this interest will be calculated daily from the next day after the due date up to and including the date of payment at the rate equal to the annual rate charged by The Commonwealth Bank of Australia (CBA) on its standard credit card purchases, as published on its website from time to time. Interest accrues daily from the due date until the date of payment in full and is calculated on a daily compounding basis.
Cancellation Fee May apply if you committed to a rental term and then cancelled the booking prior to the original pick up.

3. All fees are calculated based on our current rates and are subject to final calculation at the end of the rental period. For further details, please inquire at the counter or check online.

ANNEXURE 2 – FUEL & ELECTRICAL RECHARGE POLICY

  1. Your vehicle will be provided with a full tank of fuel, or if the tank is not full, we will credit you for the missing fuel, allowing you to decide how to pay for the fuel you use during your rental. You have the following options:

Buy a Full Tank at the Start (Fuel Purchase Option – FPO)

  1. If you purchase a full tank of fuel from us at the start of your rental, you won’t need to refill the tank before returning it.
  2. This option ensures you will not incur additional fuel charges on return, regardless of how much fuel you use.
  3. Best for: High kilometre journeys where you are likely to use a full tank.

Return with a Full Tank

  1. You can return the vehicle with a full tank of fuel, purchased from a local fuel station.
  2. Best for: Low kilometre journeys, where you are confident you will use only a small amount of fuel.

Return Without Refuelling

  1. If you prefer not to refuel the vehicle, you can return it without refuelling. This option is helpful if you are in a hurry or didn’t select FPO.Please note that fuel charges will apply if the tank is not full upon return.

Key Information

Fuel Purchase Option (FPO)

  1. When you select FPO, we charge you for a full tank of fuel at a price competitive with local fuel stations.
  2. You will not need to pay for fuel upon return, and no refund will be provided for any unused fuel.

Important

Fuel gauges may still indicate that the tank is “full” many kilometers after it was last re-filled. To deal with this, we ask you to refill the tank within 15 km of the return location and bring your fuel receipt with you when returning the Vehicle. We ask you to present a copy of the fuel receipt to a Ride Car Rentals employee or leave a copy in the Vehicle. If you do not do so, we reserve the right to apply a small charge – please ask at the counter for details.

Service Charge

  1. We will charge you a price per litre to refill the tank if the fuel level is lower than when the vehicle was initially provided.
  2. These prices are detailed in your Rental Agreement.

Electrical Recharging Costs

  1. If you return the Electric Vehicle (EV) with a lower battery charge than the level it had at the time of departure:
  2. We will charge you an EV Battery Recharging Service fee to bring the EV back to its battery departure level.
  3. If the EV is returned with a battery level of 15% or less, we will apply an additional Low Battery Recharging Service fee.
  1. If you return the EV with at least the same level of charge as at the battery departure level:
  2. If you used a Ride Car Rentals account third-party recharging station, and the recharging cost is passed to Ride Car Rentals (instead of being paid by you), we will pass on these costs to you upon receipt of an invoice from the EV charge provider. An EV Administration Processing Fee will also apply.
  3. If you fully recharged the EV at your own cost, no additional fees (including the EV Battery Recharging Service fee or EV Administration Processing Fee) will be payable.

ANNEXURE 3 – DAMAGE POLICY

Ride Waiver Application:

If you have purchased a Ride Waiver, your liability for damage will be limited to the actual cost of repair or replacement plus any applicable administrative fees, capped at the waiver amount stated in your Rental Agreement. This applies to all damage types covered by the waiver, including tyres, windscreens, keys, accessories, and towing fees. If the damage cost is less than the waiver cap, you pay only the actual cost plus fees.

Checking the Vehicle

  1. At the start of your rental, we will provide a Vehicle Condition Report (VCR) that outlines any existing damage on the vehicle.
  2. Please inspect the vehicle when you collect it. If you notice any discrepancies or damage, approach a Ride Car Rentals representative to amend the VCR or create a new report.
  3. We invite you to take time-stamped photographs of any pre-existing damage before leaving the rental location. You can present these photos to a Ride Car Rentals representative on return for clarity.
  4. Upon return, we will inspect the vehicle and create a Vehicle Incident Report (VIR) that records any new damage, excluding fair wear and tear.
  5. If you return the vehicle during peak times, please allow sufficient time for the inspection. If you return the vehicle when the location is closed, the assessment of new damage will be done in your absence.
  6. If you have taken date & time-stamped photographs of pre-existing damage, make sure to show them to a Ride Car Rentals representative upon return.

Sensors

7. Drivers are fully responsible for any damage to the vehicle, even if the sensors are not functioning correctly or are inactive. Malfunctioning sensors do not relieve the driver of liability.

Damage Assessment and Charging

8. We handle damage in three common scenarios:

Damage – Agreed on Return:

8.1 If the damage is agreed upon at the time of return, we will take the relevant photos and create a Vehicle Incident Report (VIR). We will also organize a damage cost assessment via a third-party provider.

Damage – Not Agreed (Due to Absence or Disagreement):

8.2 If you are not present at the time of return, our counter staff will take the necessary photos, create a VIR, and arrange a damage cost assessment through a third party.

8.3 If you are present but disagree with the damage identification, we will proceed similarly, with the VIR and third-party damage cost assessment.

Damage – Significant Damage (Not Agreed):

8.4 If the damage is significant and not agreed upon, we will create a VIR, refer the matter to our damage assessors for evaluation, and organize a cost assessment.

Important
Damage

We aim to deal with a damage assessment in a quick and practical way by using a 3rd party repair assessment system. The damage assessment will ensure that you are accurately charged the relevant damage cost assessment.

8.5 If you have purchased a Ride Waiver, the amount charged following damage assessment will be limited to the actual cost of the damage plus applicable administrative fees, capped at the waiver amount specified in your Rental Agreement.

Notification and Evidence of Damage

9. In case of any damage to the vehicle during your rental, you will be provided with the following documents for clarity:

  1. A system-generated letter detailing the damage to the vehicle.
  2. Photos of the damage to the vehicle.
  3. The Rental Agreement, listing the date, time, return location, and any pre-existing damage.
  4. The final tax invoice or statement of charges, including the amount charged for the damage and any other associated fees and losses.
  5. The Vehicle Incident Report (VIR).
  6. A damage cost assessment from a repair body shop or the invoice for the repairs.

Charging and Other Items

  1. Charges to Your Card: We will charge your card the amount set out in the final tax invoice sent to you within 90 days of returning the vehicle.
  2. Reimbursement: If we initially charged your card an estimated amount or applicable liability, and the final invoice is lower, we will reimburse you for the difference.

Damage Disputes

  1. Dispute Resolution: Damage claims vary, and resolution time frames may differ as we need to liaise with third parties and arrange repairs.
  2. If you wish to dispute our assessment of the damage, please contact the Ride Car Rentals Claims Management Team (contact details are found in Annexure 6 – Contacts).
  3. Incident Report: If you cause any loss or damage to the vehicle or its accessories (including keys), you must complete a Vehicle Incident Report (VIR) either during the rental period or within 24 hours of its end to benefit from any reduced or waived liability. You can obtain the VIR from the rental counter or access it online.
  4. Ride Car Rentals follows a fair wear and tear policy aligned with the Australian Finance Industry Association Code of Practice.
  5. Vehicle Condition Check: Upon collection, check the vehicle’s condition against the Pre-existing Condition Notes in your Rental Agreement.
  6. If discrepancies are found, please inform a Ride Car Rentals representative and we will update our records accordingly.
  7. Pre-existing Damage: You are encouraged to take time-stamped photographs of relevant pre-existing damage before leaving the rental location. If poor weather or lighting conditions affect visibility, you may take photographs within 60 minutes of leaving the rental location and email them to support@riderental.com.au or show them to a representative on return.
  8. Liability Waiver: Please note, the waiver is not applicable in cases of gross negligence, intentional damage, or Prohibited Use of the vehicle. In these circumstances, you remain fully liable for all damage costs, including third-party claims.
  9. Accident Reporting: Inform Ride Car Rentals of any accident or damage as soon as practicable, and within 24 hours, to ensure eligibility for any liability reduction.

Fair Wear and Tear

  1. Fair Wear and Tear: This refers to minor damage or wear that is reasonable to expect through normal use of driving a vehicle.
  2. We have listed below examples of damage that will be chargeable at the end of your rental:

Vehicle Bodywork Damage

  1. Scratches/Scrapes over 20mm in length and over 1mm wide with paint surface penetration.
  2. Dents over 20mm diameter or paint surface penetration, or multiple dents.
  3. Bumper Scratches/Scrapes over 20mm with paint surface penetration (excluding rear bumper damage from removing items from the boot/trunk).
  4. Lower Front Bumper Scuffing or scrapes above the first 50mm of the lower front bumper.

Tyre Damage

  1. Repairable Damage: Tyre repair is possible (if the tyre has not been run on a flat), and only the tyre repair excess will be charged.
  2. Unrepairable Damage: If the tyre cannot be repaired, a replacement tyre (including fitting) will be charged.
    Examples of Tyre Damage: Unrepairable punctures, sidewall damage, or damage from misuse such as flat spots or burnouts.

Ancillary Components Damage

  1. Damage to Mirrors.
  2. Damage to Lights (chips, holes, scratches, or cracks).
  3. Wheel Trims cracked, broken, missing, mismatched, or not original.
  4. Damage to Alloy Wheels.

Premium and Performance Vehicles

  1. Scuffs over 20mm in length, cracked, buckled, gouged, mismatched, or not original.

Standard Vehicles

  1. Cracked, buckled, gouged, mismatched, or not original.

Vehicle Interior Damage

  1. Missing Original Equipment.
  2. Interior Trim Damage or missing parts.
  3. Upholstery Burns, Cuts, Stains, or Tears to seats, carpets, roof lining, or material in the glove box/boot.
  4. Excessively Dirty or Bad Odour in the vehicle.

Glass Damage

  1. Repairable Damage: Between 2mm to 20mm in the Primary Vision Area (PVA).
  2. Replaceable Damage: Over 2mm in the Critical Vision Area (CVA) (90mm from the top & sides, 65mm from the bottom), or over 20mm in the Primary Vision Area (PVA).

Note on Glass Damage

22.19 If you notice a chip within 60 minutes of leaving the Ride Car Rentals location, take a photo with the date/time stamp and present it to a Ride Car Rentals employee on your return or email it to support@riderental.com.au.

In the Event of an Accident

22.20. Complete the Vehicle Incident Report (VIR) with the details of the accident or theft, including third-party information (even if there’s no visible damage to the vehicle). The VIR must be signed by you and handed over to a staff member upon vehicle return. Alternatively, the VIR can be accessed online.

If you have purchased a Ride Waiver, please note that your liability remains capped as per your waiver; however, timely reporting and documentation of incidents remain mandatory to benefit from your waiver protections.

ANNEXURE 4 – RIDE WAIVERS

  1. The Collision Damage Waiver (CDW) is included in your rental rate and reduces your liability for loss or damage to the vehicle or related third parties to the amount of the applicable Loss Damage Liability (LDL) (also referred to as “liability”) as stated on your Rental Agreement. This applies to each incident of damage or loss, except in the event of loss or damage caused by a Prohibited Use.
  2. If you have purchased a Ride Waiver, your liability will be limited to the actual cost of damage plus any applicable administrative fees, capped at the amount specified in your Rental Agreement.

Examples of Damage Covered by LDL

  1. The LDL coverage includes, but is not limited to, the following types of damage:
Impact with Fixed or Moving Objects
  1. Damage caused by collisions, such as accidents involving stationary or moving objects.
Loss of Control of the Vehicle
  1. Situations where the driver loses control of the vehicle resulting in damage.
Unavoidable Natural Events
  1. Damage caused by natural events like hail, floods, or other such occurrences that are out of the driver’s control.
Fire
  1. Damage caused by fire due to:
    1. Vehicle defects (including electrical faults).
    2. Fire from adjacent sources such as neighbouring property or vehicles.
  2. Criminal or terrorism acts.

Vehicle Used with Due Care

  1. Damage is covered under LDL as long as the vehicle is being used with due care and in accordance with the terms of the rental agreement.

Exclusions

  1. Damage caused by Prohibited Use (as detailed herein) is not covered under the Collision Damage Waiver (CDW) and you will be fully liable for any costs associated with such damage.Ride Waivers do not apply to loss or damage resulting from Prohibited Use or breaches of the Rental Agreement.

Ride Waivers
Ride Car Rentals offers Ride Waivers as optional add-ons that may reduce your financial liability for certain types of loss or damage to the rental vehicle during the rental period. These waivers are designed to provide you with cost certainty in the event of specific incidents but are subject to important limitations and exclusions.

Key Points about Ride Waivers

Not Insurance Policies:

Ride Waivers are not insurance policies. They are contractual waivers of liability that reduce the amount you may be required to pay for damage to the vehicle, subject to these terms and conditions and the Rental Agreement. Ride Waivers do not cover losses or damages arising from Prohibited Uses (as defined herein).

Exclusions:

Ride Waivers do not provide any waiver or protection for:

  • Infringements: Including traffic fines, parking fines, and private parking charges. These charges will be on-charged to your Card.
  • Fuel: Any fuel charges will not be covered under these protection services.

Following the Loss or Damage Policy:

To receive the benefit of any Ride Waiver, you must adhere to the Loss or Damage Policy outlined in Annexure 3 – Damage Policy. This includes reporting any loss or damage promptly and following the necessary procedures to document the incident. Failure to comply may result in the waiver being deemed void.

Types of Ride Waivers Available

The types of Ride Waivers that may be available to you, along with the applicable charges and the extent of any reduction in liability, will be specified in your Rental Agreement. Ride Waivers may include waivers in respect of damage to the vehicle, theft of the vehicle, or liability for third-party property damage or injury, depending on the nature of your rental and the vehicle selected.

You should review your Rental Agreement carefully to understand the waivers (if any) that apply to your rental, the applicable Loss Damage Liability (LDL) amount, and any remaining liabilities or exclusions.

These services provide peace of mind and potentially lower your financial responsibility in the event of certain accidents or damage, but you must be aware of the exclusions and limitations as mentioned.

Please Note
For Heavy Commercial Vehicles (HCVs), any applicable Ride Waiver will reduce your liability, but it will not reduce it to zero. Instead, your liability will be reduced to the amount specified in your Rental Agreement.

Toll Cover

Pre-pay a flat daily fee to cover unlimited toll charges as advised at the time of reservation.

ANNEXURE 5 – PRIVACY POLICY AND CREDIT NOTICE

Privacy and Data Collection

  1. When you rent a vehicle from Ride Car Rentals, the company needs to collect, store, use, and disclose personal information in order to provide the rental services and other related purposes. By agreeing to these terms, you confirm that you have read and understood that Ride Car Rentals will process your personal data in accordance with their Privacy Policy.

Personal Information of Others

  1. If you provide personal information about other authorised drivers or passengers, you confirm that you have the authority to share this information and that you have informed them of this Privacy Notice. Ride Car Rentals will process their personal data following the guidelines in the Privacy Policy as well.

Credit Policy

  1. If credit is provided to you, Ride Car Rentals manages your credit-related information (including credit information and credit eligibility information) as outlined in the Credit Policy. The Statement of Notifiable Matters provides details about disclosures related to credit information, along with the rights you have.

Impact of Not providing Personal Information

  1. Please note, if you fail to provide necessary personal information, it may affect the ability of Ride Car Rentals to offer the services you request.

If you have any concerns about how your data is handled or need more information about Ride Car Rentals’ Privacy Policy or Credit Policy, it would be advisable to refer to those documents directly.

Collection of Personal Information

  1. Ride Car Rentals collects personal information in various ways during the rental process:
  • 5.1 Rental Request: When you request vehicle rental services.
  • 5.2 Vehicle Use: Through a Vehicle Monitoring System (VMS), which tracks the vehicle’s location, speed, distance, and other data during the rental period.
  • 5.3 Payment Details: When you provide payment information.
  • 5.4 Accident or Loss: If the vehicle is involved in an accident, lost, or stolen.
  • 5.5 Return of Vehicle: When you return the vehicle and incur any charges.
  • 5.6 Photographs: We may take photographs of the vehicle at the start and return of your rental, as well as record images via CCTV at the rental location. We may also take your photo and a photocopy of your driver’s license.

Use and Disclosure of Your Personal Information

  1. Your personal information may be used for several purposes related to the rental process, including:
  • 6.1 Legitimate Interests: Providing vehicle rental and related services, damage monitoring, reporting, insurance claims, fraud prevention, debt recovery, and credit management.
  • 6.2 Disclosure to Third Parties: We may disclose your information to:
    • (1) Related Parties & Service Providers: This includes agents, franchisees, and insurers.
    • (2) Authorities: For toll charges, fines, and other road-related charges.
    • (3) Police: If requested.
    • (4) Credit Reporting Agencies: In cases of default.
    • (5) Debt Collection Agencies: If payments are overdue.
    • (6) Other Parties: Involved in accidents with the vehicle during your rental period.

    Vehicle Monitoring System (VMS)

    1. Our vehicles are equipped with VMS that track and record:
      • 7.1 Geographical Location.
      • 7.2 Distance and Speed of the vehicle.
      • 7.3 Vehicle Immobilisation: The system can be used to immobilise the vehicle in cases of non-payment or suspected Prohibited Use.
    2. You agree to allow the tracking of your location and vehicle use through this system.

    Marketing and Communication

    1. We may use your personal information for marketing purposes and send direct marketing communications, including emails, text messages, or post, with your consent. You can opt out of receiving marketing communications at any time by:
      • 9.1 Following the unsubscribe function in the message.
      • 9.2 Updating your preferences in your profile on the website (if applicable).

    Privacy Complaints

    1. If you believe we have interfered with your privacy, you can file a complaint according to our Privacy Policy. More details can be found in Annexure 6 (Contacts).

    Access to and Correction of Personal Information

    1. You have the right to:
      • 11.1 Access the personal information Ride Car Rentals holds about you, subject to certain exceptions.
      • 11.2 Request corrections to that information if necessary.

    Credit-Related Information

    1. We may disclose your credit information to credit reporting agencies in cases where you default on payments of $150 or more.
    2. You can request access to or corrections of your credit information as per our Credit Policy and the Statement of Notifiable Matters.
    3. If you believe we haven’t complied with our obligations as a credit provider, you can lodge a complaint according to our Credit Policy.

    ANNEXURE 7 – PROHIBITED USES

    Prohibited Uses

    1. The following actions are considered Prohibited Uses of the vehicle, and may result in additional liability or void your rental agreement:

    Geographic Limitations and Additional Charges

    2. The vehicle shall only be driven within the designated radius of 500 kilometers from the Perth Central Business District (CBD), unless prior written consent is obtained from us. You acknowledge and agree that any travel outside this designated radius without our prior written consent will constitute a breach of this Agreement.

    Severe Penalties:
    In the event of any of the following breaches, you will be liable for the corresponding penalty fee:

    • Unauthorised use outside permitted areas: $2,000
    • Reckless driving: $2,000
    • Unauthorised sub-renting or lending of the vehicle: $2,000

    3. You acknowledge that driving the vehicle outside the designated radius may result in limited or no insurance coverage. In such instances, you shall bear full responsibility for any loss, damage, theft, or third-party claims arising during the period of non-compliance with the designated radius restrictions, including but not limited to repair, recovery, and legal costs.

    4. In the event of an incident or breakdown occurring outside the designated radius, you will be responsible for all associated recovery costs, including but not limited to towing, transportation, and any third-party service charges.

    5. Ride Car Rental reserves the right, at its sole discretion, to modify the designated radius based on operational requirements or risk assessments. Any changes will be communicated to you in writing and shall apply from the date of such notification.

    6. By accepting the vehicle, you hereby acknowledge and agree to the designated radius restrictions outlined in this clause and understand the financial and liability implications of exceeding the designated radius.

    Reckless or Intentional Actions

    7. If you, an authorised driver, or your passenger act recklessly or deliberately, cause loss or damage to the vehicle.

    Types of Vehicle Damage

    8. The following types of damage are prohibited:

    • 8.1 The vehicle rolls, tips, or falls over, causing damage to the side and/or roof.
    • 8.2 Undercarriage damage caused by the driver.
    • 8.3 A person sitting or standing on the roof of the vehicle.
    • 8.4 Damage above the windscreen line (front, rear, or side) caused by striking overhead or overhanging objects (e.g., trees, bridges, or low-clearance parking structures).
    • 8.5 Damage caused by securing luggage, skis, or other items to the roof.
    • 8.6 Driving the vehicle with a flat tyre, ignoring a warning light, or putting the wrong fuel in the vehicle.

    Unapproved Repairs

    9. Repairing the vehicle without prior written approval from Ride Car Rentals. If repairs are authorised, an original tax invoice and receipt must be provided for reimbursement.

    Driving Under the Influence

    10. Driving under the influence of drugs, alcohol, or any intoxicating substances that impair the driver’s ability to control the vehicle.

    11. If the driver refuses to provide a breath, blood, or other sample when lawfully requested, they are considered to be over the legal limit.

    Fitting Unauthorised Objects

    12. Fitting objects to the interior or exterior of the vehicle that have not been authorised by Ride Car Rentals.

    Failure to Safeguard the Vehicle

    13. Failing to take reasonable precautions to safeguard the vehicle, such as leaving windows open, keys in the vehicle, or not using the anti-theft system (if provided).

    Illegal or Unlawful Acts

    14. Using the vehicle for any illegal or unlawful acts, other than traffic offences that do not result in the loss of a driver’s license in the applicable state or territory.

    Unauthorised Drivers

    15. Allowing someone who is not authorised as the main or additional driver, or who does not meet the driver requirements in the Agreement, to operate the vehicle.

    Use on Racetracks or Contests

    16. Using the vehicle on a racetrack, for racing, or for undertaking reliability trials, rallies, or any other contests.

    Sub-renting or Selling the Vehicle

    17. Sub-renting, transferring, or selling the vehicle.

    Commercial Use

    18. The Renter must not use, or permit any other person to use, the Vehicle to carry passengers or freight for hire, reward or remuneration, including but not limited to operating as a taxi, rideshare or ride-hailing service (e.g. Uber, DiDi, Shebah), chauffeur service, courier service, or any similar on-demand transport or delivery platform.

    Improperly Loaded Goods

    19. Using the vehicle to haul goods that are incorrectly loaded or for hauling goods the vehicle was not designed for, including hazardous materials or explosive substances.

    Towing without Authorisation

    20. Towing a trailer or another vehicle without prior approval or without the vehicle being fitted with an approved towbar by Ride Car Rentals. Towing is only permitted if the item being towed does not exceed the specified capacity of the vehicle.

    Overloading the Vehicle

    21. Overloading the vehicle with passengers or baggage beyond the vehicle’s recommended limits.

    Driving on beaches or through flooded roads

    22. Driving the vehicle on a beach, through a flooded road, or any body of water (including potholes, ditches, or riverbeds), or during a natural disaster (fire, storm, or cyclone).

    Restricted Areas

    23. Driving the vehicle in restricted areas, including airport service roads, areas notified by Ride Car Rentals as prohibited, or off-road (e.g., fire trails, tracks, fields, or paddocks), unless specified in writing by Ride Car Rentals.

    Bringing disrepute to Ride Car Rentals

    24. Using the vehicle in any manner that could bring Ride Car Rentals into disrepute or publicly associate the company with any political, religious, promotional, or activist position.

    Damage to Electric Vehicles (EVs)

    25. Driving an EV through a car wash or over foreign objects that could cause damage to the vehicle.

    Driving on unsealed roads

    26. Driving the vehicle on unsealed roads, except for roads under repair or access roads to recognised camping or accommodation grounds.

    Driving in Prohibited Areas

    27. If you engage in any of the Prohibited Uses, you may be held fully liable for any damages or additional costs incurred.

    Important Information on Prohibited Uses

    Termination of Agreement:

    If there is a Prohibited Use of the vehicle, we have the right to terminate the rental agreement at any time, with or without notice, and take back the vehicle. This action will be at your expense.

    Liability for Loss or Damage:

    If a Prohibited Use has caused or contributed to loss or damage to the vehicle or any third party, you will be fully liable for that loss or damage. This includes the full value of the vehicle.

    Related losses and fees, including any third-party losses as detailed in the Damage and Loss section.

    Responsibility for Authorised Drivers:

    You are also responsible for the actions of any authorised drivers of the vehicle. Even if they are at fault, you will remain liable.

    ANNEXURE 8 – DEFINITIONS

    Term Definition
    Rental Agreement The document headed “Rental Agreement” denoting a unique reservation number, and other specific information including names and contact details of the Parties, signed by You when the Vehicle was picked up.
    Rental Start Date The date and time the rental commences as shown on the rental agreement.
    Authorised Driver Drivers who we have validated and authorised to drive the vehicle; these drivers should be noted in your rental agreement under “Authorised Drivers”.
    Initial Fuel Supply The amount of fuel in the tank of the rental vehicle provided to you on pick up. Fuel supply is noted on your rental agreement.
    Accessory Means any equipment rented from us, including but not limited to as applicable any Navigational system, child restraint, child booster seat or similar equipment.
    Material Breach

    A Material Breach occurs if:

    • The vehicle is used for a Prohibited Use;
    • The vehicle is driven on a Prohibited Road;
    • The vehicle is driven by an individual that does not meet the licence and age requirements set out in this agreement;
    • You or an authorised driver provide false or misleading information to us prior to, or throughout the term of the rental, which may reasonably be considered as material to our decision to grant you and continue you to grant you, a rental.

    Such material information includes matters such as age, name, licence status, address, occupation, eligibility for any discount, or incident that occurs during the rental.

    Refer to the list of Prohibited Uses at Annexure 7.

    You/Your The person who signed the rental agreement.
    Term Definition
    “Us”, “We”, “Our”, “Ride Car Rentals” Ride Car Rentals and Leasing Pty Ltd ABN 684 514 967, 51 Furniss Road, Darch, 6065, Western Australia.
    Vehicle Means the road vehicle you have rented, which may be any of the above, and includes all vehicle parts, tyres, tools (supplied with the vehicle), and all other accessories or equipment in or fitted to the vehicle by the manufacturer or by Ride Car Rentals, such as keys.
    EV Means a road vehicle with an electric motor, powered by electricity stored in a battery.
    Commercial Vehicle Means a motor vehicle capable of carrying goods, 10 or more passengers and can be used for industrial and agricultural purposes.
    Heavy Commercial Vehicle Means a vehicle classed as a heavy truck or bus that requires a ‘specialized vehicle’ license to drive. It is a vehicle that has a gross vehicle mass (GVM) or aggregate trailer mass (ATM) of more than 4.5 tonnes.
    Prohibited Use Means the circumstances in Prohibited Uses at Annexure 7.
    Applicable Consumer Protection Law

    Means a reference to consumer protection law (as that term is normally understood) including:

    • The Australian Consumer Law
    • The Australian Securities and Investments Commission Act 2001
    • Laws or any other Federal, State or Territory legislation, as amended from time to time.
    Vehicle Monitoring System
    “VMS”
    Our vehicles may be fitted with a VMS which is used to open and close the vehicle and track and record the geographical location, distance, and speed of the vehicle during the rental period. It can also be used to immobilize the vehicle in the event of non-payment or if we have reasonable grounds to suspect the vehicle is being used for a Prohibited use.
